Terms of Service

Applies to: constructivegreg.com, the Tekla Open API course, and the
accompanying software skill (together, the “Service”).

These Terms are the regulamin świadczenia usług drogą elektroniczną required by art. 8
of the Polish Act on Providing Services by Electronic Means. They are made available free of
charge before you place an order, in a form that lets you download, save, and print them.

1. What these Terms cover, and what they do not

1.1 These Terms govern your use of this website, the ordering process, and your access to the
course. Three further documents form part of them:

  • the End User License Agreement — what you may and may not do with the
    software skill, and who owns it;
  • the Refund & Cancellation Policy — withdrawal, refunds, and
    chargebacks;
  • the Privacy Policy — what personal data we process and why.

1.2 Where a subject is dealt with in one of those documents, that document governs it. These
Terms do not repeat their contents.

1.3 By placing an order or using the Service you confirm that you have read these Terms and
that you are at least 18 years old and legally able to enter into a contract.

2. What the Service consists of

2.1 The Service is digital content supplied without a tangible medium:

  • the course — online video lessons with written notes and code samples,
    streamed on this website through an account created for you; and
  • the skill — a downloadable package of documentation, code templates, and
    helper scripts for use with an AI coding agent, licensed to you under the EULA.

2.2 The course is delivered in English. Lesson count, running time, and curriculum are as
described on the course page at the time of your purchase.

2.3 The skill contains static files only. It installs no services, contains no executables,
and has no telemetry. Each copy carries a per-buyer identifier as described in Section 5 of the
EULA.

3. Technical requirements

3.1 To watch the course you need a current web browser with JavaScript enabled and a working
internet connection able to stream video. Lessons are embedded from Vimeo.

3.2 To follow along and use the skill you need, on a Windows machine:

  • Tekla Structures, licensed to you. The course is recorded on Tekla
    Structures 2025 and the material applies to Tekla 2021 and newer; older versions work with a
    different package, which the skill handles.
  • An AI coding agent with its own subscription. The course is taught using
    Claude Code in VS Code. The skill is not tied to a particular agent, but the lessons show that
    one.
  • VS Code, the .NET SDK 6.0 or newer, and the
    .NET Framework 4.8 Developer Pack. Installing the two .NET components
    typically requires administrator rights on the machine.
  • Network access to api.anthropic.com, claude.ai, and
    api.nuget.org, which corporate firewalls sometimes block.

3.3 You supply the third-party software yourself. A Tekla Structures licence
and an AI-agent subscription are not included in the price, are bought from their own vendors on
their own terms, and are not resold by us. We are not affiliated with, endorsed by, or sponsored
by Trimble or Anthropic; see Section 10 of the EULA.

If you are buying through an employer, the one-page technical summary for
an IT or security review is available on request at greg@constructivegreg.com — it lists every
install, endpoint, and category of data that leaves the machine.

4. Ordering, and who you contract with

4.1 Payment is taken by Lemon Squeezy, LLC, our seller of record, not by
us. Lemon Squeezy sells the Service to you in its own name: it takes the payment, applies the VAT
or sales tax due in your country, and issues your invoice. Your payment contract is with Lemon
Squeezy and is subject to Lemon Squeezy’s own buyer terms, shown at checkout. Delivery of the
course and the skill, support, and everything else in these Terms remain our responsibility.

4.2 The charge appears on your card or bank statement under a Lemon Squeezy descriptor, not under
“Constructive Greg”. If you do not recognise a charge, please check your purchase
receipt and contact us before disputing it with your bank.

4.3 To order you select the offer on the course page, open the checkout, enter your email
address and payment details, tick the two confirmations described in Section 4.4, and submit. The
contract is concluded when the payment is accepted and confirmed to you by email. Before
submitting, you can go back and correct any detail you have entered.

4.4 Because the Service is delivered immediately, the checkout requires you to confirm two
things: that you request immediate access, and that you
acknowledge losing the 14-day right of withdrawal as a result. Both are
unticked by default and the checkout will not proceed until you tick them. This is explained in
full in the Refund & Cancellation Policy, which you should read
before you buy.

4.5 Prices are shown in euro on the course page. The price you pay is the one displayed at
checkout, which may add VAT or sales tax depending on your country and whether you supply a valid
business VAT number. Promotional prices apply only while displayed and only to orders placed
during that period.

5. Delivery and access

5.1 On confirmed payment, an account is created automatically for the email address used at
checkout and you are sent a message containing a link to set your password. Access to the course
normally begins within minutes.

5.2 Your personalised copy of the skill is prepared separately, because each copy is stamped
for the buyer. It is delivered within 24 hours of purchase, by email or as a
download inside the course.

5.3 If you have not received account details within one hour, check the spam folder for the
address used at checkout, then email greg@constructivegreg.com with your order reference. Delayed
delivery caused by a mistyped or non-receiving email address is put right as soon as you tell us.

6. Your account

6.1 An account is personal to one named individual. Where an organisation buys, one licence
covers one named individual within it; see Section 1.3 of the EULA.

6.2 Keep your credentials confidential. Do not share your login, publish
lesson videos or downloads, or make the course available to anyone who has not bought it.

6.3 You may not scrape, bulk-download, re-upload, or circumvent access controls on any part of
the Service.

6.4 Where an account is shared or the course is redistributed, we may suspend access. For a
serious or repeated breach we may terminate it, and the licence terminates with it under Section
7 of the EULA. Where the breach can be put right, we will tell you what is wrong and give you a
reasonable opportunity to do so first.

7. How long your access lasts

7.1 The skill is yours permanently. The licence granted by the EULA is
perpetual, the files are downloadable, and nothing in this Section limits them. Keep your own
copy.

7.2 Course access is a hosted service and is guaranteed for at least 24 months
from your purchase. In practice we intend to keep the course available for longer, and while it
remains available your access continues.

7.3 If we ever retire the course, we will give you at least 90 days’ notice by
email
before access ends, so that you can finish it or save your notes. Where retirement
would fall inside your 24-month guaranteed period, we will either extend access to the end of
that period or refund a fair proportion of what you paid.

7.4 Free updates. Lessons added or re-recorded during your access period are
included at no extra cost. Where an offer was sold as including lifetime updates, that promise
attaches to updates: you pay nothing further for them, for as long as the course is offered. It
is not a separate promise to host the course beyond this Section.

8. Availability, maintenance, and changes to the content

8.1 We aim to keep the Service available continuously, but we do not guarantee uninterrupted
access. It may be briefly unavailable for maintenance, updates, or reasons outside our control,
including failures at our hosting, video, or payment providers.

8.2 We may improve or reorganise the course — re-recording a lesson, adding material, or
replacing content that a new Tekla release has made obsolete. We will not materially reduce what
you bought. Where a change would materially reduce it and cannot be avoided, Section 12 applies.

9. Intellectual property

9.1 The course, the skill, and this website are protected by copyright. Rights are reserved as
set out in Section 4 of the EULA.

9.2 What you build is yours. Nothing here claims ownership of the tools you
write in your own work, including where they started from a code sample. The permitted uses are
set out in Section 2 of the EULA.

10. If something is wrong — conformity and complaints

10.1 We owe you a Service that conforms to its description. If the course or the skill is
faulty, incomplete, or not as described — for example lessons are missing, corrupted, or
persistently inaccessible — you are entitled to a remedy under Directive (EU) 2019/770, the
Polish Act on Consumer Rights, and the Polish Civil Code.

10.2 The order of remedies is: we bring the Service into conformity, normally by restoring
access, replacing a file, or correcting the content. If we cannot do so within a reasonable time
and without significant inconvenience to you, you may demand a proportionate
price reduction, or terminate and be refunded.

10.3 How to complain. Email greg@constructivegreg.com, or
write to the postal address in Section 15. Include the email address used at checkout, your order
reference, what is wrong, and what you would like us to do about it.

10.4 We aim to reply within 5 business days, and will respond to a complaint under this
Section within 14 days of receiving it. If we do not respond in that time, the
complaint is treated as accepted.

10.5 Billing, invoice, VAT, and payment-method questions go to Lemon Squeezy, whose details are on
the receipt emailed to you. Anything about the course or the skill comes to us.

11. Withdrawal and refunds

Withdrawal, refunds, and chargebacks are governed by the
Refund & Cancellation Policy. In short: the 14-day withdrawal right
is waived at checkout in exchange for immediate access, so there is no automatic right to a
refund — and this does not affect the conformity rights in Section 10, which cannot be waived.

12. Business buyers, and sole traders buying outside their specialty

12.1 Where you buy in the course of a business or profession, no consumer withdrawal right
arises and the consumer-specific provisions of these Terms do not apply to you.

12.2 One exception, and it will apply to many readers. If you are a natural
person running a sole proprietorship registered in Poland (CEIDG) and the purchase is not of a
professional character for you — judged mainly by the subject of your own registered activity —
then under art. 38a and art. 7aa of the Polish Act on Consumer Rights you are treated broadly
as a consumer — art. 38a for the right of withdrawal, art. 7aa for the digital-content
conformity rules in Section 10. If you think that is your
position, say so when you contact us and we will apply it.

13. Liability

13.1 The Service is educational. You remain professionally responsible for the engineering
work you do and for verifying any code before it touches a production model. The disclaimer of
warranties and limitation of liability in Sections 8 and 9 of the EULA apply to these Terms.

13.2 Nothing in these Terms excludes or limits liability that cannot lawfully be excluded,
including for death or personal injury caused by negligence, for intentional fault, or under
mandatory consumer-protection rules.

14. Changes to these Terms

14.1 We may change these Terms — for example when the Service changes or the law does. The
current version is always on this page with its “Last updated” date.

14.2 A change never applies retroactively to a purchase already made. Your
order is governed by the version in force when you placed it. Where a change materially affects
existing buyers, we will notify you by email at least 14 days before it takes effect; if you do
not accept it, you may stop using the Service and, where the change materially reduces what you
bought, ask us to unwind it under Section 10.

15. Governing law and disputes

15.1 These Terms are governed by the law of the Republic of Poland. If you
are a consumer resident elsewhere in the EU or the UK, this does not deprive you of the
protection of mandatory provisions of the law of your country of residence.

15.2 Please contact us first — nearly everything is resolved by email in a
day or two.

15.3 A consumer may also use out-of-court routes: the local
powiatowy (miejski) rzecznik konsumentów, the provincial Trade Inspection Authority
(Wojewódzki Inspektorat Inspekcji Handlowej), or the guidance published by the Polish
Office of Competition and Consumer Protection (UOKiK) at
uokik.gov.pl. Consumers resident in another EU
country can contact their national European Consumer Centre. We are not obliged to take part in
out-of-court proceedings and decide case by case.

15.4 Disputes with a buyer who is not a consumer are subject to the courts having jurisdiction
over our registered address.
